DECLARACIÓN ANTE LA GRAVE SITUACIÓN EN CHILE / STATEMENT

Al gobierno de Chile y la opinión pública nacional e internacional:

Lxs abajo firmantes, trabajadorxs, académicxs, intelectuales, activistas, artistas y ciudadanxs, condenamos de manera enérgica la suspensión de las libertades constitucionales que afectan a la población chilena tras la declaración del Estado de Emergencia, la represión policial, la salida de los militares a la calles y los toques de queda en diferentes regiones del país.

Tal como lo muestra la historia reciente en varios países de América Latina, la profundización de las brechas sociales, la desigualdad, la pobreza y la violencia estructural han generado un enorme malestar en la sociedad y una creciente deslegitimización del sistema de representación político. Los pueblos del continente, sin embargo, han sabido resistir mediante la lucha social, la solidaridad y la memoria histórica.

Es importante señalar que si bien las protestas de los últimos días en Chile surgieron ante el alza del pasaje del metro de Santiago, son una respuesta ante una continuidad de abusos estructurales que han afectado la vida cotidiana de lxs ciudadanxs. Estos abusos están institucionalizados en el sistema previsional de AFP, la precariedad y crisis actual de la salud pública, la precarización de la educación pública escolar, la privatización del acceso al agua y bienes básicos, el consiguiente endeudamiento extremo de las familias e individuxs y la contrastante e inmoral acumulación de la riqueza en las manos de unos pocos. A esto se suman los últimos casos de corrupción de instituciones que habían jugado un papel importante en la sociedad chilena, como la de las empresas privadas, el financiamiento de la clase política, hasta las elites de Carabineros y de las Fuerzas Armadas. Todas estas son dimensiones implicadas en el profundo y furioso malestar que ha estallado en los últimos días, y que ha sido criminalizado por el gobierno y los medios de comunicación como manera de desactivarlo. La falta de respuesta de los gobernantes ante las demandas de una población cansada por décadas de medidas unilaterales neoliberales ha terminado en esta movilización social.

Ante esta alarmante situación, expresamos lo siguiente:

Rechazamos el estado de excepción declarado por el gobierno, en razón de que vulnera derechos humanos fundamentales, establecidos en la Convención Americana Sobre Derechos Humanos y en el Pacto Internacional de Derechos Civiles y Políticos, ambos suscritos por el estado chileno, tales como el derecho a la libertad personal, la libertad de expresión, la vida e integridad personal, debido proceso y otros derechos constitucionales que siguen plenamente vigentes. El Estado de Excepción restringe el diálogo y en muchos casos profundiza la violencia y agudiza las divisiones sociales.

Rechazamos el enmarque de este conflicto político como una cuestión de delincuencia y de seguridad del estado. La criminalización de la protesta social es una práctica antidemocrática, ya utilizada profusamente en los tiempos de las dictadura cívico-militares del Cono Sur, intentando borrar el derecho a las legítimas demandas de la sociedad civil.

En consecuencia y en nombre de los principios universales de derechos humanos y de nuestra memoria histórica, exigimos al gobierno del presidente Sebastián Piñera el cese inmediato de la represión aplicada en el marco del estado de excepción, la inmediata liberación de todas y todos los detenidos, y la suspensión de la aplicación de cualquier medida criminalizadora de la protesta para así abrir de manera urgente un espacio de diálogo y respeto con los distintos sectores sociales involucrados.

To the government of Chile; to the national and international public opinion,

The undersigned, workers, academics, intellectuals, activists, artists and citizens, strongly condemn the suspension of constitutional liberties that are affecting the Chilean population after the declaration of the State of Emergency; the police repression; the placement of the military on the streets; and the curfews in different areas of the country.

As recent history has shown us, in different countries of Latin America the deepening of social differences, inequality, poverty and structural violence have generated enormous discontent in these societies and an ever-growing delegitimization of the system of political representation. Nevertheless, the peoples of the continent have shown time and again they know how to resist through social struggle, solidarity, and the practice of historical memory.

It is important to note that even though the protests of the last few days in Chile arose due to the raises to subway fares in Santiago, they are a response to a series of structural abuses that have affected the daily lives of the people living in the country. These abuses are institutionalized in the AFP retirement fund system, the precariousness and the current crisis of the public health system, the precarization of public education, the privatization of access to water and basic goods, the ensuing extreme indebtedness of families and individuals, and the contrasting and immoral accumulation of wealth in the hands of a few. To this we should add the cases of corruption within institutions that play an important role in Chilean society, such as the police, the armed forces, and cases of private firms financing the political class. All of these dimensions are implicated in the deep and furious discontent that has erupted in the last few days and that has been criminalized by the government and the media as a way of deactivating it. The lack of response by the government in the face of the demands of a population tired from decades of unilateral neoliberal measures have lead to this social mobilization.

Given this alarming situation we express the following,

We reject the state of exception declared by the government because it infringes upon fundamental human rights—rights stated in the American Convention of Human Rights ad the International Pact of Civil and Political Rights, both subscribed by the Chilean state—such as the right to individual liberty, freedom of expression, the right to life and personal integrity, due process, and other constitutional rights that are still fully in force. The State of Exception curtails dialogue and in many cases deepens violence and sharpens social divisions.

We reject the framing of this conflict as a question of crime and national security. The criminalization of social protests is an antidemocratic practice—already profusely used in the times of the civic-military dictatorships in the Southern Cone—that tries to erase the right of civil society to its legitimate demands.

In consequence and in the name of the universal principles of human rights and of our historical memory, we demand to the government of president Sebastián Piñera the immediate stop to the repression applied through the state of exception, the immediate liberation of all prisoners, and the suspension of the application of any measure that criminalizes social protest, so it is possible to open the urgent space for dialogue and respect with all the social sectors involved.
